Discrimination：

1．“废止、废除”辨析：

Abrogation：通过立法，其他有权机关的行为或依惯例撤销或废止以前的法律或惯例。与提出法案rogation相对。

Repeal：指制定新的法规时，明确宣布废止原有的现代法规，即“明示废止”；或新的法规与原有法规在内容上互相抵触或互相矛盾，不可能同时并存。

Derogation：（对法律、权利等的）限制，部分废除。指后来制定的法律规定限制原先法律的适用范围或强制力，从而导致其部分废除。

Subrogation：代位。指由一人取代另一人的地位而对第三人依法请求给付或主张权利，要求补救或担保等。

Dispensation：（为法律所禁止的行为的）特许；（为法律所规定行为的）特免。

Antiguation：（罗马法）废弃法律。

Abrogation与derogation 的区别：后者指废止法律的一部分。

Abrogation 与subrogation的区别：后者指条款的取代。

Abrogation 与dispensation的区别：后者指仅在某一特定的案件中才排除该法的适用。

Abrogation 与antiquation 的区别：后者指拒绝通过某一法律。
